1. Introduction to the Terms

1.1 This site is owned and operated by the Hong Kong Designers Association Limited (Association).

1.2 This site is designed to provide a platform, enjoyable for all, for the exchange of opinions, comments and information and, therefore, the Association requires its users to abide by these Terms. Use of the site will constitute users’ agreement to comply with these Terms.

1.3 All postings by users do not represent the point of view of the Association and the organising committee of Hong Kong Designers Association Global Design Awards 2013.

1.4 If users do not agree with these Terms, please do not use the site.

1.5 We may terminate users’ access to the site, without prior notice, in addition to our other remedies if users fail to follow these Terms.

2. Use of the Site

2.1 Users are responsible for ensuring that any post on this platform does not violate the copyright, trade mark, trade secret or any other personal or proprietary rights of any third party.

2.2 Users agree not to disrupt, modify or interfere with the site or its associated software, hardware and servers in any way, and users agree not to impede or interfere with others' use of the site. Users further agree not to alter or tamper with any information or materials on, or associated with, the site.

2.3 Users of “The Design Issue” platform warrant and undertake that they will not:
-post libellous or defamatory comments;
-post anything relating to any ongoing or pending trial;
-post content which users have copied from someone else (i.e. users do not own the copyright);
-use profanities;
-post a personal insult about another user;
-advertise or solicit;
-impersonate another user; or
-post material that is deliberately intended to upset other users.

2.4 Should the Association become aware of any activity that would be contrary to the Terms or determine in their sole discretion to be unacceptable, then the Association reserve the right to take action including temporary or permanent removal of content, filtering of internet transmissions and/or to exclude the user with immediate effect and, where necessary, to forward any incriminating material in its possession to the Hong Kong police or other relevant authorities.

2.5 Users accept that the Association may keep a record of your IP and/or host address for reference purposes only (in order to keep a track on the amount of visitors per day). In the event of any breach of these Terms, the Association may view and add your IP and/or host address to an 'excluded database' to prevent you gaining further access to the site. These addresses are not distributed or given out to any third party services.

3. Use of Material Posted by User

3.1 Postings to “The Design Issue” platform are not private. Users grant the Association a perpetual royalty free non-exclusive licence to use, reproduce, modify, translate, transmit, distribute and sub-licence any information or material you supply or communicate to the site via such postings, in any medium now in existence or hereafter developed, for any purpose, including commercial uses to any third party. The Association will not return it if submitted, and accepts no liability whatsoever for safe custody thereof.

4. Copyright and Copyright Complaints

4.1 The Association grants users a limited, non-exclusive, revocable, non-transferable licence to use the site content solely for personal use relating to your use of the site. Except as expressly set out herein, neither you nor anyone acting on your behalf acquires any intellectual property rights relating to any site content. Any rights not expressly granted within these Terms are reserved.

4.2 By sharing any contribution(s) with us, users agree and grant the Association and its sub-licensees, free of charge permission, to use the Contribution(s) at the Association’s sole discretion (including modifying and adapting it for operational and editorial reasons) in connection with the operation of the Site and our business. The licence extends to copying, distributing, broadcasting or otherwise transmitting, adapting or editing the Contribution(s).

4.3 If users believe that their work has been copied and is accessible on any sites of the Association in a way that constitutes copyright infringement, or that the site contains links or other references to another online location that contains material or activity that infringes users’ copyright, please contact us at +852 2776-9142.

5. Data Disclaimer

Hong Kong Designers Association pledge to meet fully, and where possible exceed, internationally recognized standards of personal data privacy protection, in complying with the requirement of the Personal Data (Privacy) Ordinance. In doing so, the Association will ensure compliance with the strictest standards of security and confidentiality.

6. Data Collection and Use

6.1 Hong Kong Designers Association collect personal data from our site visitors on a voluntary basis. Personal information may include name, address, e-mail address, etc. The information is used only by the Association for the purposes stated in the respective screens on which the Association invite you to provide your data. The Association do not use any personal data for any other purposes without prior consent unless such use is permitted or required by law.

6.2 Every visit to Hong Kong Designers Association's website, the Association records the visit only as a "hit" and does not collect any personal identifiable information about visitors. The "hit" information is to allow Association to compile general statistics to show the daily number of visitors to Association's site.
